Traders In Purple Ambassador Club Program Terms and Conditions 

1.0 Under Traders In Purple Ambassador Club Program (Ambassador Club), Ambassador Club members may be eligible for various benefits including:

Third party offers, products, or services as available from time to time

2.0 Who can become an Ambassador Club member?

Any company or individual over the age of 18 named as a purchaser under a Sales Contract for any existing or future Traders In Purple projects (refer to the list of eligible projects at bottom of Terms & Conditions), whether purchasing solely or jointly is eligible to become an Ambassador Club member.

There is no fee payable to become or remain an Ambassador Club member.

2.1 When do Ambassador Club membership benefits commence?

Upon your Sales Contract becoming unconditional, the benefits of the Traders In Purple Ambassador Club Program commence.

2.2 Membership for company members and their nominees

Where the name on the Sales Contract is under a company, the company may nominate up to two individuals to be Ambassador Club members. Those individuals must be either shareholders or directors of the purchaser and must not have been nominated previously or be an existing Ambassador Club member. This nomination is to be made in writing at the time of entering into the Sales Contract.

2.3 Acceptance of terms and conditions

By claiming or accepting any Benefit under Ambassador Club, the Ambassador Club member confirms that it accepts these terms and conditions.

3.0 Traders In Purple Purchase Rewards

Ambassador Club members are entitled to receive a discount for all subsequent Sales Contracts that are entered into in accordance with this section 3.

3.1 Amount of repeat purchase reward

The repeat Purchase Reward is a two per cent (2%) discount off the list price of all subsequent purchases. This discount is also available to the Immediate Family Members of the Ambassador Club members. Immediate Family is defined as someone’s spouse, parents and grandparents, children and grandchildren, brothers and sisters, mother in law,father in law, brothers in law and sisters in law, daughters in law and sons in law. 3.2 Payment of repeat purchase reward

The two per cent (2%) discount is by way of an adjustment to the purchase price at settlement, on the basis that the sales contract is settled in accordance with the terms and conditions of the contract.

4.0 Referral Rewards

Ambassador Club members are entitled to receive a referral reward of $2,000 when they introduce a new buyer to the Traders In Purple in accordance with this section.

4.1 Pre-conditions to receipt of the referral reward

Each of the following conditions must be satisfied for an Ambassador Club member to be entitled to a referral reward:

(a) the referring Ambassador Club member (Referrer) must:
(i) have entered into an unconditional Sales Contract with Traders In Purple and not be in breach of the Sales Contract;
(ii) complete the on-line Referral Form on or before the Sales Contract is signed by the Referred Purchaser; and
(iii) not otherwise be excluded under section 4.6; and
(b) the referred purchaser (Referred Purchaser) must:
(i) be an individual or company;
(ii) on or before entering into the relevant Sales Contract, nominate or confirm to Traders In Purple that the Referrer was their referrer;
(iii) enter into an Sales Contract; and
(iv) satisfy the Purchaser Conditions in the Sales Contract; and must not be:
(iv) satisfy the Purchaser Conditions in the Sales Contract; and must not be:
(v) an existing Ambassador Club member; or
(vi) already known to Traders In Purple as a potential purchaser, including by being previously introduced or referred to Traders In Purple by another party or Agent or appearing on a Traders In Purple sales database.
(vii) a direct family member related to the Ambassador Club member who is also receiving a 2% discount off the list price.
(vii) a direct family member related to the Ambassador Club member who is also receiving a 2% discount off the list price.

4.3 Only one referral reward is payable on each Sales Contract.

4.4 Multiple referral rewards

There is no cap on the amount, or number of, referral rewards that an Ambassador Club member may be paid for referring new purchasers to Traders In Purple. However, the referral reward is only available on the first Sales Contract entered into by the Referred Purchaser and not on any subsequent purchases by the Referred Purchaser.

4.5 Payment of referral reward

The referral reward will be paid to the Referrer within 10 Business Days of the Referred Purchaser’s Sales Contract becoming fully unconditional. If the Referrer is a company, the referral reward will be paid to one person that the authorised representative of the company nominates in writing.

4.6 Exclusions

Despite any other term or condition, no referral reward is payable:

(a) to an Agent or Agent’s Associate, when the referral is made in relation to a property:
(b) for which an Agent is entitled to a sales commission or other similar payment;

5.0 On becoming an Ambassador Club member, members will receive:

(a) notification of any upcoming Development stage releases; and

(b) access to purchase such properties,

before they are notified, or released for sale to the general public (unless the Ambassador Club member has unsubscribed from receiving these notifications or access).

6.0 Discounts as The Sebel Brisbane Margate Beach

On becoming an Ambassador Club member, members will receive 15% discount on Accommodation  The Sebel Brisbane Margate Beach (up to a value of $500 in any one stay). Ambassador Club members may also receive a complimentary room upgrade subject to availability. This discount is subject to the Ambassador Club member providing proof on booking or payment of their membership and is not transferrable to any third party.

7.0 Termination and breach of Sales Contract

If a Sales Contract is brought to an end before settlement for any reason or the Ambassador Club member breaches or defaults under a Sales Contract, the contract will no longer be a Sales Contract and the Ambassador Club member cannot rely on it for the purpose of receiving Benefits under the Ambassador Club.

This applies, for example, when the contract has been terminated before settlement, or when the purchaser is no longer a purchaser under the contract either through nominating or assigning to an alternative purchaser.

7.1 Nomination or assignment

The original purchaser (and any Ambassador Club member seeking to rely on that contract) must notify Traders In Purple in writing within 10 Business Days of entering into any documentation to effect a nomination or assignment of the Sales Contract. In the case of nomination or assignment, the new purchaser may rely on this contract for its eligibility for Benefits, subject to the new purchaser and the Sales Contract satisfying these terms and conditions.

8.0 Traders In Purple may, in its discretion, notify Ambassador Club members from time to time of additional Benefits offered to Ambassador Club members by Traders In Purple or third parties.

8.1 Each Benefit may have specific terms and conditions applicable, including a limited period or availability for that Benefit.

Ambassador Club members must not:
(a) act in any way that breaches these terms and conditions;
(b) abuse or misuse the Ambassador Club program;
(c) supply or attempt to supply false or misleading information or make a false representation to Traders In Purple;
(d) sell, assign or transfer, or offer to sell, assign, or transfer, the Ambassador Club member’s membership in Ambassador Club or any Benefit; or
(e) seek to obtain any commercial benefit from the Ambassador Club program.

8.2 Traders In Purple agrees to use any Personal Information collected in accordance with the Group Privacy Policy. The types of personal information we may collect, and hold includes name, address, date of birth, age, language preferences and nationality, contact details like phone numbers and email addresses, as well as electronic information from your use of our website.

8.3 An Ambassador Club member agrees to provide Traders In Purple with Personal Information in order to participate in Ambassador Club, and to keep that information up to date. If an Ambassador Club member does not provide or update the Personal Information required by Traders In Purple, the Ambassador Club member acknowledges that it may not be entitled to receive certain Benefits under the Ambassador Club program.

8.4 Traders In Purple may send electronic communications to the Ambassador Club member regarding third party offers, products and services available as part of Ambassador Club. Ambassador Club members can unsubscribe from such electronic communications by using the unsubscribe functionality in these communications. An Ambassador Club member may cancel its membership at any time by sending an email request to ambassadorclub@tradersinpurple.com.

9.0 Ambassador Club Membership

Traders In Purple reserves the right (in its absolute discretion, and particularly in the case of a breach by an Ambassador Club member) to:
(a) refuse to accept any person becoming an Ambassador Club member;
(b) exclude or withdraw an Ambassador Club member from Ambassador Club;
(c) refuse to honour any Benefit accumulated by an Ambassador Club member;
(d) reverse any Benefit accumulated or awarded by an Ambassador Club member;
(e) suspend an Ambassador Club member’s participation in Ambassador Club; or
(f) terminate an Ambassador Club member’s participation in Ambassador Club.

10.0 Variations to Ambassador Club Terms & Conditions

Traders In Purple reserves the right (in its discretion and without notice) at any time to:
(A) cancel, substitute or vary any of the benefits, terms and conditions of Ambassador Club member (in whole or in part); or
(B) exclude, substitute, vary or withdraw any participating Developments (in whole or in part).

Traders In Purple will endeavour to give Ambassador Club members notice of any cancellation, substitution or variation to Ambassador Club under this condition by either email, mail or SMS and provide notice on the Ambassador Club website.

Benefits accumulated by Ambassador Club members prior to the cancellation, substitution or variation of Ambassador Club may still be honoured at the Traders In Purple’s absolute discretion.

11.0 Liability

To the maximum extent permitted by law, Traders In Purple is not liable for any cost, loss or damage incurred in connection with:
(a) any withdrawal, cancellation, variation or change to these terms and conditions;
(b) any breach of these terms and conditions by any person or Traders in Purple ; or
(c) providing, or not providing, any Benefit.

11.1 Traders In Purple’s decisions are final Traders In Purple’s decision on all matters relating to Ambassador Club, including any dispute as to the identity of an Ambassador Club member or entitlement to any Benefit, is final and binding.

12.0 GST and Tax

(a) The amount of any Benefit specified in these terms and conditions (including if specified by way of a percentage of another amount or otherwise) includes the amount of any GST or similar value added tax (if any) payable or arising on or in relation to the benefit.
(b) If providing any Benefit is the consideration for a taxable supply for GST purposes, the relevant Ambassador Club member must deliver a tax invoice, or an adjustment note to the Traders In Purple entity who is the recipient of the taxable supply before the Ambassador Club member is entitled to payment of any amount in relation to any Benefit.
(c) Any tax, liability or duty in relation to any Benefit provided to an Ambassador Club member will be the sole responsibility of the Ambassador Club member. Ambassador Club Members should contact their accountant or taxation advisor if they have any queries relating to the tax implications of Ambassador Club.

13.0 Governing law

These terms and conditions are governed by New South Wales law. Any person relying on, or seeking to enforce, these terms and conditions submits to the nonexclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.

14.0 Severability

If any provision of these terms and conditions is unenforceable or invalid, it must be read down so as to be enforceable and valid. If this is not possible, the provision may be severed without affecting the enforceability or validity of the remaining provisions.
